WINDSOR MEADOWS CONDOMINIUM
THIRD AMENDMENT TO THE DECLARATION
NOW COMES Coastwise Management, LLC, a New Hampshire Limited Liability
Company, having a principal place of business at 100 Main Street, Suite 140,
Dover, County of Strafford, State of New Hampshire, and says:
1. That the condominium was declared on September 26, 2000 by Declaration of
Condominium recorded in the Rockingham County Registry of Deeds, Book 3506, Page
2311.
2. That the condominium has been previously amended by instruments recorded
in Rockingham Records at Book 2514, Page 1169 and Book 3521, Page 1595.
3. That recorded substantially contemporaneously with the Declaration was a
plan entitled "Proposed Site Plan - Phase I and Phase II Household Realty
Trust Tax Map 4, Block 1 Lot 40" as plan D-26807, Sheet 3 of 6, as Plan
D-26807.
4. The Declarant is about to file an amendment to the condominium which will
convert the Phase II Convertible Land as described in Appendix C to the
Declaration and create a total of 24 additional units as shown on a plan
entitled "Tax Map 4, Block 1, Lot 40 North Road Brentwood, N.H. Site Plan
Phase II Windsor Meadows Condominium for Coastwise Management, L.L.C." to
be recorded.
5. Said plan depicts portions of units 60 and 42 encroaching into the
previously declared Phase I of the condominium.
6. The encroachment is necessary in order that the buildings containing the
units are constructed in accordance with the Town of Brentwood site plan
regulations relating to the distance between multi-family structures.
7. Pursuant to Article V, Section 20 of the Declaration and Article VIII of
the By-Laws and R.S.A. 356-B 11, the following amendment is made:
A. Units 42 and 60 to be registered and built as part of Phase II of the
condominium encroach over the Phase line into Phase I as shown on recorded
site plans.
B. The Declarant acknowledges and authorizes the encroachment as shown on
said plan.
C. Said encroachment shall not be construed as affecting any unit owner's
undivided interest in the common area.
IN WITNESS WHEREOF, Coastwise Management, LLC, Does hereby adopt the above
referenced amendment pursuant to the authority recited above, by causing the
hand of John H. Farrell, its duly authorized Manager to be set hereto this 12th
day of January, 2001.
